With reference to Mr. Ellis's letter of the 15th instant, (reference 72817/30), enclosing a copy of a despatch from the Governor of Hong Kong in regard to the importation of French brandies, I am directed by the Board of Customs and Excise to

state, for the information of the Secretary of State, that under section 1 of the Immature Spirits (Restriction) Act, 1915, French brandy (inter alia) may not be delivered for home consumption in this country unless it has been warehoused for a period of at least three years. Any period shown to the satisfaction of the Board to have elapsed between the dates of distillation and importation is treated for the purposes of the Act as a period during which the brandy has been warehoused.

The Board accept as evidence of the age of brandies imported from France a declaration made by the shipper or other responsible person having knowledge of the facts, provided that his signature is attested by a British Consul, or by a Notary Public and afterwards legalised by the British Consular Officer of the district in which the Notary resides. Or the declaration may be made before a Mayor whose signature is legalised by a British Consular Officer
